Welcome to Cosmic Cupcakes. By using this website or placing an order, you agree to the following Terms & Conditions. Please read them carefully before purchasing.

1. General Information

Cosmic Cupcakes is a Georgia Cottage Food Operation, operating legally under Cottage Kitchen Address ID# 6203835. All baked goods are prepared in a home kitchen that is not subject to routine governmental food inspection.

Products are sold locally and delivered via approved third-party delivery services and sometimes the company itself.

2. Ordering & Payment

  • All orders must be placed through this website, by direct communication with Cosmic Cupcakes, or via a third-party delivery service that Cosmic Cupcakes uses directly.

  • Payments are processed securely through Stripe on the website lovecosmiccupcakes.com.

  • Orders are only confirmed once payment is received.

  • Prices may change at any time without notice.

  • You agree that all information you provide is accurate and complete.

3. Allergens & Food Safety

Our cupcakes may contain:

  • Milk

  • Eggs

  • Wheat

  • Soy

  • Tree nuts or peanuts (depending on recipe)

Because items are made in a home kitchen, cross-contamination cannot be fully prevented.
Customers with severe allergies should use caution.

Cosmic Cupcakes is not liable for allergic reactions, food sensitivities, or improper food handling once the product has been delivered.

4. Local Delivery

Love Cosmic Cupcakes uses third-party delivery services (such as Uber Eats, DoorDash, or local courier partners) to deliver orders.

By ordering:

  • You acknowledge that delivery may be performed by an independent third-party service.

  • You agree that any delays, damages, or issues occurring during delivery are the responsibility of the delivery provider.

  • Once an order is handed to the delivery driver, risk transfers to the customer.

If a delivery issue occurs, we will assist you in contacting the delivery partner, but we are not responsible for their actions, timing, or errors.

5. Pickup (For Batch Orders Only)

Pickup is available only for batch orders of 12 cupcakes or more.

When selecting the pickup option:

  • Pickup must occur at the agreed-upon date and time.

  • Pickup location details will be provided after the order is confirmed.

  • If you arrive late, Cosmic Cupcakes cannot guarantee product freshness or temperature stability.

  • Because cupcakes are made fresh, orders not picked up at the scheduled time are not eligible for refunds or remake.

  • Once the order is handed off at pickup, responsibility for proper storage and handling transfers to the customer.

6. Refunds, Cancellations & Order Changes

Because each order is baked fresh:

Refunds

Refunds are only provided if:

  • The wrong item was made

  • An order cannot be fulfilled based off of Cosmic Cupcakes decree

No refunds are given for:

  • Taste preferences

  • Allergic reactions

  • Delivery delays caused by third-party delivery services

  • Orders not picked up

  • Damage after the order leaves the business facility

Cancellations

  • Cancellations must be made within 24 hours of placing the order.

  • Custom orders cannot be canceled once work has begun.

Order Changes

Changes to orders must be requested as soon as possible.
Approval is not guaranteed.

7. Quality Assurance & Order Verification

Cosmic Cupcakes follows a strict Quality Assurance process.
A clear, timestamped photo of each completed order is taken before it leaves our possession—whether for delivery or pickup.

These photos are used to:

  • Confirm order accuracy

  • Document cupcake condition at the time of handoff

  • Resolve order-related disputes

Quality Assurance photos include products only and do not capture customers or delivery drivers.

Once the order has been handed off for delivery or picked up by the customer, Cosmic Cupcakes is no longer responsible for any damage, melting, smudging, or alteration that occurs during transport or after receipt.

8. Product Descriptions

We aim to display and describe our cupcakes accurately, but:

  • Colors may appear differently due to lighting or screen settings

  • Decorations may vary slightly since everything is handmade

By ordering, you accept small variations.

9. Website Use

You agree not to:

  • Misuse this website

  • Attempt unauthorized access

  • Reproduce or copy the website content without permission

All images, text, branding, and designs are the property of Cosmic Cupcakes.

10. Limitation of Liability

To the fullest extent permitted by law:

Cosmic Cupcakes and the person, Morgann Wilburn, the creator of Cosmic Cupcakes, as well as, any staff working for Cosmic Cupcakes, are not liable for:

  • Damages or losses related to website use

  • Delivery delays or mishandling by third-party services

  • Allergic reactions or personal food sensitivities

  • Misuse of products after pickup or delivery

  • Indirect, special, or consequential damages

Your sole remedy for any claim is limited to the amount paid for the order.

11. Privacy

Your personal information is handled according to our Privacy Policy, which explains:

Stripe handles all payment information securely.
